If you or someone you know has been arrested for driving under the influence or DUI in the San Francisco Bay Area, you need to act now. Two separate cases are initiated against an individual by the State of California immediately upon arrest for DUI a criminal case and a civil case at the Department of Motor Vehicles or DMV Driver's Safety Office.
The DUI criminal case occurs in the county of the drunk driving arrest. San Francisco County has only one courthouse so all DUI cases in the City are handled at 850 Bryant Street. Likewise Marin County, Sonoma County and Napa County also only have one court house where DUI cases are heard. DUI criminal cases in Santa Clara County are heard in San Jose, Palo Alto and San Martin while Alameda County DUI cases can be heard in Oakland, Dublin or Fremont. Contra Costa County hears DUI cases in Richmond, Pittsburg and Martinez while San Mateo County DUI cases can be heard in either Redwood City or South San Francisco. If you're DUI arrest happened outside of San Francisco, the first thing you should do is confirm when and where your first court appearance or arraignment will be held. The first hearing in a driving under the influence or DUI case is your arraignment. Depending on the seriousness of the individuals DUI case, the court can order the individual back to jail, require an ankle monitor or even suspend the defendant's California Driver's License, just while the criminal case is pending!
Most California driving under the influence cases are misdemeanors unless the DUI case involved a collision and caused injuries to another person under California Vehicle Code Section 23153. Nevertheless, there are several DUI enhancements that can significantly increase the punishment for a first offender causing additional DUI school, jail or community service, probation, fines and fees, or even installation of an ignition interlock device or IID. So, whether you're guilty of DUI or not, a good DUI defense lawyer can easily justify himself by getting a DUI sentence reduced, having the charges reduced or in some cases, obtaining a complete dismissal or the DUI case either legally or a DUI defense.
The second case is at the Department of Motor Vehicles or DMV Driver's Safety Office. The DMV hearing must be requested within ten days of the DUI arrest or it will be waived and the individual's California Driver's License will automatically be suspended thirty days after the date of the DUI arrest. However, if the DMV hearing is requested within ten days of the DUI arrest, the Department of Motor Vehicles will issue a stay of suspension and a new temporary license which will be valid until the outcome of the Administrative Per Se DMV hearing. California DMV license suspensions for a first offense DUI can go up to one year without the possibility of a restricted license.
California DMV hearings can be won! DMV hearings are civil in nature and for that reason the Department relies almost exclusively on documents when making a license suspension decision for a California DUI. Therefore, the real issue at most DUI DMV hearings is the admissibility of the documents, not their content. Only a trained DUI lawyer knows the right objections and arguments to make to the DMV to potentially avoid a license suspension. I've personally won DMV hearings with blood alcohol concentration of over .20% based on questions of evidence admissibility.

"When I first hired my attorney for my DUI case, I knew nothing about Nors. I was told by some friends to be represented by Robert Tayac, because he was the best. Throughout most of my case, I only dealt with Nors. I never even met Robert until my actual hearing date, when my sentence was going to be determined. Even though my blood alcohol level was barely over the legal limit, I still had the potential to be served with a DUI. When Mr. Tayac came out of the courtroom, he said I was to be charged with a DUI. This would also mean that I would lose my driver's license for 6 months. In a panic, I called Nors, who was on his way from another case. Nors assured me, "don't panic, I'm on my way". When Nors arrived to the courtroom, he then said that although he didn't know if it would work, he would try going back into the courtroom to ask for an extension and another hearing date. Mr. Tayac never even offered me that option. Well, as it turned out, Nors DID get the extension for me, and when we went back to court a month later, he got my charges reduced to a wet and reckless, which means I would not have a DUI charge on my record.
In addition, Nors also fought for me at the DMV, and I never had my driver's license suspended, not even for one day. "Nors is 100% the best DUI attorney I've had the experience working with. I received my first DUI in San Jose about 7 years ago. I was trying to flag down a cab and instead I ended up flagging down a cop instead. Rather than put me in a cab the arrested me for drunk in public. Then I was released, given the keys to my car and told to 'go home'. I tried to do exactly that and was immediately pulled over for a DUI..!!! In all honesty, my "First DUI" should have NEVER been a DUI - drunk in public "requires" the police to hold you 'until you are no longer a harm to yourself or others' - that's the law. They broke the law and told me to go home and gave me essentially a weapon. I thought I was only hungover, I could not fathom they would let me drive home drunk. I went through about $10,000 - $15,000 and 3 THREE law firms.
